IMPORTANT LEGAL NOTICE: Please read these Terms of Engagement carefully. By accessing the digital nodes of Xentharyl Studios(referred to as "the Studio"), downloading experimental software builds (including APK installations), participating in beta evaluation programs, or engaging with our interactive operations, you agree to be bound by these terms. If you do not agree to these terms, you are strictly prohibited from accessing our systems or installing our software.
⚠️ NOTICE OF BINDING ARBITRATION & CLASS ACTION WAIVER
THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. EXCLUDING THOSE JURISDICTIONS THAT STRICTLY PROHIBIT SUCH PROVISIONS, ALL DISPUTES ARISEN BETWEEN YOU AND XENTHARYL STUDIOS (AND ITS OPERATING ENTITY OR AFFILIATES) SHALL BE RESOLVED THROUGH BINDING, INDIVIDUAL ARBITRATION rather than in a court of law. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR JURY TRIALS globally.
1. Scope of Agreement and Age Eligibility
These Terms govern all access to our websites, interactive properties, game servers, digital applications, and telemetry dashboards. To engage with our software, you must represent that you have reached the legal age of majority in your jurisdiction of residence, or that your legal parent or guardian has reviewed and explicitly consented to these Terms of Engagement on your behalf.
2. Proprietary Rights and Corporate Structure
Xentharyl Studios operates as a high-fidelity digital production brand. All assets housed within this digital realm, including but not limited to codebases, compiled binaries, graphics, thematic screen designs, soundscapes, dynamic styling protocols, user interface components, and promotional material, are the exclusive intellectual property of the Studio and its operating entity.
Any feedback, optimization reports, suggestions, or bug submissions provided to us during alpha/beta phases shall automatically become the sole property of Xentharyl Studios, with no royalty, attribution, or compensation owed to the submitter under any legal framework worldwide.
3. Software Testing License & Absolute Restrictions
Subject to your compliance with these Terms, we grant you a highly limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and execute compiled application binaries (APKs, executable builds) solely for individual, non-commercial testing and evaluation purposes.
You explicitly agree that you shall NOT, under any legal circumstance:
- Decompile, disassemble, dump, or reverse-engineer any component of our software or APIs.
- Distribute, re-host, mirror, or repackage compiled binary structures (APKs) on external servers or third-party marketplaces.
- Use automation engines, cheat scripts, or memory injectors to modify game telemetry or client-side runtime values.
- Attempt to bypass authentication models, intercept API calls to our Firestore/Firebase databases, or execute DDoS operations.
- Extract textures, soundtracks, 3D models, or text strings from the software bundle for any commercial or public display.
4. Absolute Disclaimer of Warranties
EXPERIMENTAL ARCHITECTURE STATUS:
ALL SOFTWARE AND DIGITAL SYSTEMS MANAGE BY THE STUDIO (INCLUDING EARLY ACCESSIBLE ALPHA, BETA, AND COMPILATIONS) ARE DELIVERED "AS IS" AND "AS AVAILABLE," WITH EVERY FAULT AND DISCREPANCY CONCEIVABLE. THE STUDIO AND ITS AFFILIATES DISCLAIM ALL REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR FUNCTION, AND NON-INFRINGEMENT.
The software is experimental by design. You acknowledge that installation of early builds (APK formats) is executed entirely at your own risk. The Studio does not warrant that software operations will run uninterrupted, that the platform is free of server faults, or that telemetry syncs will remain preserved.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY THE SOVEREIGN LAW OF YOUR APPLICABLE JURISDICTION, XENTHARYL STUDIOS, ITS EXECUTIVE BODY, AFFILIATES, DEVELOPMENT PARTNERS, AND LICENSORS SHALL UNDER NO CIRCUMSTANCES BE HELD LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES, BUT IS NOT BOUND TO, DAMAGE FOR SYSTEM DOWN-TIME, HARDWARE BRICKING, DATA ERASURE, TELEMETRY ERRORS, DEVICE INTERRUPTION, COMPROMISED SYSTEM METRICS, AND LOSS OF DATA OR REVENUE, ARISEN OUT OF OR IN CONNECTION WITH THE SOFTWARE.
IN ALL EVENTS, THE TOTAL COLLECTIVE LIABILITY OF THE STUDIO TO YOU UNDER ALL LEGISLATIVE ACTIONS OR CONTRACTS SHALL BE LIMITED TO THE EXACT AMOUNT EXPENDED BY YOU TO ACCESS OUR SYSTEMS ($0.00 USD).
6. Mutual Indemnification
You agree to defend, indemnify, and hold completely harmless Xentharyl Studios, its directors, employees, parent entities, and technical operators from and against any and all liabilities, legal disputes, expenses, court claims, losses, and damages (including legal counsel fees) arising from your direct violation of these terms or misuse of the testing software distribution channels.
7. Governing Law and Severability
These Terms shall be interpreted and governed under the laws of the main operational region of the Studio, without regard to conflict of law principles. If any section, paragraph, or clause of these Terms of Engagement is determined to be invalid or unenforceable under a local judicial body, such portion shall be reformed to the minimum extent necessary to make it legally compliant, and the absolute remainder of these Terms shall continue in full force and effect.
